The Products are sold to the Customer identified by the data entered at the time of compilation and transmission of the electronic order form with simultaneous acceptance of these Terms of Sale. By placing an order on this Site, you are guaranteeing us that you are an adult (18 years old) and have the legal ability to enter into a binding contract. The Customer is forbidden to use false, invented and/or imaginary names while placing an order, as well as in the following communications. The Seller Alby Srl reserves the right to prosecute any violation or abuse in the interests and defense of all customers. By accepting these Conditions of Sales, the User acknowledges to be, if the situation arises, the only one responsible for committing any error or providing incorrect tax documents while placing the online order, thus releasing the Seller Alby Srl from any liability that may derive from these errors.
Online Sales
The term “Online sales contract” indicates the remote contract for the sale of goods by Alby Srl on website www.paoloalbizzati.com between the User and the Seller Alby Srl.
To make a contract for the purchase of one or more Products, you must fill out the electronic Order Form and send it to the Seller over the Internet by following the relative instructions.
The Order Form contains:
- a reference to these General Conditions of Sale;
- information about each Product and its price;
- the methods of payment
- the delivery methods and the relative shipping costs;
- a reference to the conditions for exercising you right of withdrawal;
- the methods and times for return and reimbursement.
Alby Srl ensures that the photographs on the Site faithfully reproduce the original colors, using technology to reduce any inaccuracy to a minimum. It is however still possible to encounter some differences, caused by the technical characteristics and the color resolution on the user's device.
Consequently, the Seller will not be liable for any inaccuracy of the Product pictures on the website due to the above technical reasons, since these pictures are only for illustrative purposes.
Before concluding the contract, you will be asked to confirm that you have read the General Conditions of Sale, including the Notice of the right of withdrawal and the Privacy Policy.
The contract is concluded when the Seller Alby Srl receives your Order Form over the Internet and verifies that everything is correct. The language available for concluding the contract with the Seller is Italian or English and the contract is governed by Italian law. After the conclusion of the contract, the Seller Alby Srl will be responsible for fulfilling your order.
Order Fulfillment
By completing the Order on the website, the User unconditionally accepts and commits to observe these General Conditions of Sale.
After the order is confirmed and the payment received by Alby Srl, the contract is concluded, the Seller will send to the User an Order Confirmation email, which will contain the information relevant to the purchase.
It is possible that, before sending the Order Confirmation, the Seller will contact you by email address or telephone number you indicated, in order to request additional information regarding your internet Order.
The Seller Alby Srl may refuse to fulfill your Order when payment has failed, where Order appears incomplete or incorrect, or the ordered Products are unavailable. In these cases, the User will be notified via email, providing the relevant reasons, that the contract could not be concluded and thus will not be fulfilled by the Seller. If the product is unavailable, the user will be refunded.
Prices
The prices and taxes are set automatically. While processing the Order, before shipping Alby Srl will verify the prices. Should the price displayed on the Site be lower than the actual selling price, as a result of oversights or other errors, Alby Srl will contact the user, asking if he/she still wants to purchase the Product at the correct price. If the user declines, Alby Srl will cancel the order and refund the amount. Should the right price of an item be lower than that shown on the Site, Alby Srl will only charge you the correct, lower price, will send you the Product and will refund the amount of discrepancy.
If the Products present on the Site become unavailable after the user has already placed the Order, Alby Srl will notify the user as soon as possible for replacement or refund.
The Seller commits to deliver the purchased Products to the Customer within a period of maximum thirty days after the contract has been concluded.
Except where otherwise explicitly stated in writing, all Product prices, shipping and delivery expenses indicated on the Site and in the Order are expressed in Euros or US dollars. For purchases from Italy and Europe the vat tax will be added at the checkout. For the customers outside the European Union no tax will be added during the checkout on the website, but the user may be asked to pay local import taxes, which Alby Srl is not responsible for. The valid price is always and exclusively that which is shown during the checkout at the moment when the Order is finalized and sent to the Seller. Product prices and shipping costs may change during the checkout. Make sure to always check the final price before concluding an order.
All Products are shipped directly from Italy. Product prices and shipping and delivery costs are stated on the Site and in the Order form.

Credit Cards and Prepaid Cards
We accept payments by Credit Card and Prepaid Card without charging any additional fees to the Product and shipping costs. You must be the holder of a valid Credit Card at the time of your Order.
PayPal
The user can pay using the paypal service.
During the automatic purchase on the website The Seller Alby Srl will never have access to Credit Card information, such as the number of the credit card or its expiration date, which is sent directly to the subject that manages the electronic payment, a bank or PayPal. This data is not kept by the Seller in any computer archive. Thus, the Seller cannot, in any case, be considered liable for any fraudulent or undue use of Credit and prepaid cards by third parties. If the user decides to provide the credit card information to the Seller by email or phone call, the seller can use this information only after direct authorization from the customer.
Shipping and Delivery of the Products
Each shipment contains the Product(s) ordered and the shipping document/invoice. Purchased Products will be delivered with the courier, selected by the Seller to the shipping address indicated in the order.
Returns and Refunds
The Customer can decide to return any Product within 14 days from the date of delivery. Within those 14 days, the goods must be shipped back to the Seller Alby Srl by the Customer. The following conditions must be observed if you want to return an item:
The Products must be returned to Alby Srl in their original conditions, complete with labels and in their original packaging, which ensures that they have not been damaged or worn.
If returned items that have been damaged, washed, altered or used, the products will not be eligible for a refund.
In order to return a purchased item, you need to send an email to the address help@paoloalbizzati.com stating your surname, name, order number, the name of articles you want to return and reason for a return. The Customer Care Service will reply in 3 working days providing you the return document and instructions how to return to your country.
Upon receiving the returned merchandise, Alby Srl will check it. If no issues are found the customer will be refunded using the same payment method used to make the purchase.
Nonconforming Products
The Seller Alby Srl is responsible for defects in any of the Products sold on the Site, including the non-conformity of the items delivered, to those displayed and ordered on the Site.
In the case of non-conformity of the Products, the Customer has the right to choose among having the Product repaired or replaced with no additional fee, receiving an appropriate price reduction, or canceling the order and being refunded.
All the expenses for the replacement of defective Products will be covered by the Seller.

Customers may use the ODR platform to access a list of ODR bodies, a link to each of these bodies and to commence an online dispute resolution procedure.
Modification and Updating
The Seller Alby Srl may modify or amend these General Conditions of Sale at any time. Therefore, the Customer accepts only those General Conditions of Sale, valid at the time of the purchase. The new General Conditions of Sale will be effective from the date of publication on the Site www.paoloalbizzati.com and valid only for the Orders placed after their date of publication.
